Terms of use

The agreement between Ferculon and each restaurant that uses it. Version draft-1, 4 October 2026.

Draft. These terms are to be reviewed by a lawyer before Ferculon opens to restaurants. Highlighted parts are still to be filled in.

1. Who we are

Ferculon is run by the legal name of the company, its registered address and its business registration number ("we", "us"). In these terms, "you" is the restaurant business that uses Ferculon, and the "account holder" is the person who opened its account.

2. What Ferculon is

Ferculon is a tool for restaurant businesses in Mauritius. It takes orders at the counter, at the table and online, sends them to the kitchen, takes payments and prints receipts, keeps the reservation book and the waitlist, keeps a guest list, counts stock, and reports on takings and tax. It has a back office on the web and an app for the restaurant's tablets and phones.

It is made for businesses, not for consumers. Guests who book or order through a restaurant's page are that restaurant's customers.

4. Price and payment

The price of Ferculon and how it is paid are agreed in writing between us and the restaurant before the account opens: fees, billing period, payment terms and notice. Nothing is sold or paid for inside the app.

6. Guests' details

The restaurant is responsible for its guest list under the Data Protection Act 2017 of Mauritius. We keep that list on the restaurant's behalf and use it only to run Ferculon for that restaurant. Each restaurant's page links to a privacy notice for its guests. The restaurant answers its guests' requests; the back office has the tools to export everything kept about a guest and to erase a guest.

8. Keeping Ferculon running

We work to keep Ferculon available and to protect it, and we may change or improve features. Service levels, planned maintenance notice, and how we tell the account holder about changes that affect them.

9. Suspending an account

We may suspend an account that is used unlawfully or that puts other restaurants or guests at risk, and we tell the account holder why. Notice periods and how a suspension is lifted.

10. Liability

Limits and exclusions of liability, to be written with the lawyer.

11. Law

These terms are governed by the laws of Mauritius, and the courts of Mauritius decide any dispute. Confirm with the lawyer.
